Fabulingua, Inc. (“Fabulingua”, “we”, or “us”) values individual privacy, and we are committed to protecting individuals’ information.

This Privacy Notice (this “Notice”) describes the types of information we collect, how we collect it, what we do with the information, and how you can contact us with any questions about our information practices or to access or request changes or updates to information concerning you.

Scope

This Notice applies to information that we collect through our public website at fabulingua.com, and any of our other websites that provide a link to this Notice, as well as information collected through any of our products and services accessible via those websites, such as our mobile app or teacher’s portal (collectively, the “Site”), from you as an individual user (“you”) of the Site.

This Notice also applies to information collected through our mobile applications on both iOS and Android platforms (the "App").

This Notice does not apply to information collected by other means or information collected by third parties, third-party websites, or content or applications of third parties, including any that may be linked to or accessible from or on the Site.

Children’s Privacy

Compliance with COPPA

The Children’s Online Privacy Protection Act of 1998 and its rules (collectively, “COPPA”) require us to inform parents and legal guardians (“parents”) about our practices for collecting, using, and disclosing personal information from children under the age of 13 (“children”). It also requires us to obtain verifiable consent from a child’s parent for certain collection, use, and disclosure of the child’s personal information. We take our obligations under COPPA very seriously and are committed to protecting children’s privacy.

This section notifies parents of:

  • The types of information we may collect from children.

  • How we use the information we collect about children, including personal information.

  • Our practices for disclosing that information.

  • Our practices for notifying and obtaining parents’ consent when we collect personal information from children, including how a parent may revoke consent.

This section only applies to children under the age of 13 and supplements the other provisions of this Notice. Only the other provisions of this Notice apply to teens and adults.

Information We Collect from Children

Children can access many parts of the Site and App and use many of their features without providing us with personal information. However, some content and features require us to collect certain information from them.

We collect information about a child only when the child’s parent provides that information during the registration process. We do not collect more information than is reasonably necessary for the child to participate in an activity, and we do not condition their participation on the disclosure of more personal information than is reasonably necessary.

Information We Collect Directly from Children

For a FabuLingua family account, a child’s parent must provide us with the following information on behalf of their child to register with the Site and App:

  • Child's Nickname: Used to personalize the child's experience within the App.

  • Animated Profile Icon: Selected to represent the child's profile.

We also require the parent to create an account that includes:

  • Valid Email Address: Used for account creation and communication.

  • Password and PIN: For account security and parental controls (we recommend these be kept private from the child).

We may request additional optional information from the parent on behalf of the child, such as the child’s age and language proficiency level, to enhance the learning experience.

Parental Consent

How We Obtain Verifiable Parental Consent

Before collecting personal information from your child, we require that you provide verifiable parental consent. We obtain this consent through the following process:

  1. Registration: Parents must register for an account using their email address and create a secure password and PIN.

  2. Consent Form: During registration, parents are presented with a consent form outlining our data collection practices and must agree to the terms before proceeding.

  3. Email Confirmation: We send a confirmation email to the parent's provided email address to verify consent.

Parents have the right to revoke consent at any time by contacting us at support@fabulingua.com.

Information Collected Inside the App

When using our App on iOS or Android devices, we collect certain information directly from you to create an account for our game, which allows players to save and restore their progress. The information collected includes:

  • Email Address: Required to create and manage your account, authenticate your identity, and enable account recovery.

  • Name: Used to personalize your experience within the game.

Providing this information is necessary to create an account and utilize the full features of our game, including progress restoration.

Automatic Information Collection

We use technology to automatically collect information from our users, including children, when they access and navigate through the Site and App and use certain features. The information we collect through these technologies includes:

  • Device Information: Such as device type, operating system, and app version.

  • Usage Data: Information about how the App is used, including the features accessed and time spent.

Use of Persistent Identifiers

We collect persistent identifiers (such as device IDs) solely to support the internal operations of the Site and App, including:

  • Maintaining or analyzing the functioning of the App.

  • Performing network communications.

  • Authenticating users.

  • Protecting the security and integrity of the user and the App.

We do not use persistent identifiers to track users across different apps or websites or to serve behavioral advertising.

How We Use Your Child’s Information

We use the personal information we collect from your child to:

  • Register the child with the Site and App.

  • Allow players to save and restore game progress across devices.

  • Provide personalized content and experiences.

  • Communicate with the child within the App about activities or features that may be of interest (with parental consent).

We use the information we collect automatically to:

  • Support the internal operations of the App.

  • Analyze usage patterns to enhance the learning experience.

Our Practices for Disclosing Children’s Information

We do not sell or rent children’s personal information in any instance. We do not share or transfer any child's personal information to any third party except in the following cases:

  • Service Providers: We may disclose personal information to third-party service providers (operators) who perform functions on our behalf, such as hosting services and customer support. These operators are bound by confidentiality obligations and are prohibited from using personal information for any other purpose.

  • Legal Requirements: If required by law or legal process, such as to comply with a court order or subpoena, or to respond to a government or regulatory request.

  • Protection of Rights: If we believe disclosure is necessary to protect the rights, property, or safety of Fabulingua, our customers, or others.

In the event of a merger, acquisition, or sale of assets, we may transfer personal information to the successor organization, subject to the same commitments stated in this Privacy Policy.

Accessing and Correcting Your Child’s Personal Information

At any time, you, as a parent, may:

  • Review your child's personal information maintained by us.

  • Require us to correct or delete the personal information.

  • Refuse to permit us from further collecting or using your child's information.

Operators That Collect or Maintain Information from Children

Below is a list of all operators (third-party service providers) that may collect or maintain personal information from children through the Site and App:

    • Purpose: Email communication and management of user data such as name and email address.

This operator is required to comply with COPPA and is prohibited from using personal information for any purposes other than those directed by us.

Information You Provide to Us

Use of Customer.io

We use Customer.io for email communications and account management. Your name and email address are used solely for internal purposes, such as:

  • Sending updates and newsletters.

  • Providing important information about your account.

We do not sell or disclose this data to any third-party agencies for marketing purposes.

If there is information that you are required to provide or that we are required to collect by law or contract, we will inform you at the time of collection and explain any consequences of not providing the information.

Information We Collect Automatically

As part of the standard operation of the Site and App, we automatically collect certain information from your device:

  • Device Information: Device type, operating system, and app version.

  • Usage Data: How you use the Site and App, including pages visited and features used.

Information collected automatically is generally statistical data and does not directly identify you. It helps us improve our Site and App and deliver a better experience.

Sub-processors

We utilize certain third-party service providers (sub-processors) to assist in providing our services. Below is our current sub-processor who may process your personal information:

This sub-processor is contractually obligated to protect your information and comply with applicable privacy laws, including COPPA.
